A spousal open work permit lets the spouse or common-law partner of a foreign worker, international student, or PR applicant work for almost any employer in Canada. The permit does not tie your partner to one job or one company.

This used to be an easy permit to get. That changed in January 2025. Immigration, Refugees and Citizenship Canada (IRCC) tightened the rules to link spousal work permits to higher-skilled jobs and longer academic programs. A further update in March 2026 added more restrictions for student spouses. Because of this, your eligibility now depends heavily on the principal applicant’s job type or study program, not just their status in Canada.

Who Qualifies for a Spousal Open Work Permit

Eligibility falls into a few categories now.

Spouses of Foreign Workers

Your partner may qualify if the principal worker holds a job in TEER 0 or TEER 1. Certain TEER 2 and TEER 3 occupations on IRCC’s approved list also qualify. Most TEER 4 and TEER 5 jobs no longer make the cut. The principal worker generally needs a good amount of valid work authorization left, so timing matters here.

Spouses of International Students

Your partner may qualify if you are enrolled in a master’s program that runs 16 months or longer, a doctoral program, or a professional degree program on IRCC’s designated list. Most undergraduate degrees and college diploma programs no longer qualify on their own. If you are in your final academic term when you apply, IRCC will refuse the application, even if you already hold a permit and are trying to renew it.

Spouses of PGWP Holders

If your partner already holds a Post-Graduation Work Permit and works in a TEER 0, 1, 2, or 3 job, you may still qualify for an open work permit.

Sponsored Spouses Applying for PR

If your spouse is sponsoring you for permanent residence and you are already in Canada with your application in process, you can apply for an open work permit under a separate public policy. This route works differently from the TEER and study program rules above and remains available for now.

When to Apply

You can apply for a spousal open work permit from inside Canada or from outside the country, depending on your situation.

If you apply from outside Canada, you send your application through the visa office that handles applications for your country. This route can take longer and may involve extra document processing steps.

If you plan to visit your spouse in Canada, some applicants can apply at the border or airport, but this only works in specific situations where a temporary resident visa is not required. Most applicants apply online instead, since it gives a clearer processing timeline.

Timing is very important under the new rules. If you are a student spouse nearing the end of your program, plan your renewal well before your final term begins. Waiting too long can lead to a refusal.
